What We’ re Watching
FROM NEW LABOR LAWS and scope-of-practice rules to international sustainability mandates, today’ s spa operators face a more complex compliance landscape than ever before. What used to be a matter of local licensure and health inspections now extends to global frameworks, evolving employment classifications and rising consumer expectations around accessibility, ethics and environmental responsibility. Across every segment of the spa industry, regulatory changes can directly affect operations, staffing, insurance and even product use. Here are the key issues and developments we’ re monitoring on behalf of our members:
Global oversight trends Sustainability and ESG compliance l Trend: Increased pressure to demonstrate environmental, social and governance( ESG) accountability. l Implication: Spas are being evaluated for water usage( especially hydrotherapy), energy efficiency, waste management and labor practices. l Oversight: National and international frameworks like the EU Green Deal and the UN’ s Sustainable Development Goals( SDGs) are shaping compliance expectations.
Medical spa regulation and scope of practice l Challenge: Medspa treatments like Botox, fillers and IV therapy blur the line between spa and medical services. l Oversight bodies: Health departments and medical boards are cracking down on non-licensed providers. l Liability risk: Improper supervision or unlicensed practice creates serious legal and reputational exposure.
United States-specific issues Patchwork licensing and reciprocity l Concern: No federal licensure standards for spa professions; requirements vary widely by state. l Effort: We’ re tracking interstate compacts currently in development or early implementation for massage, esthetics and cosmetology professionals.
Employment law and independent contractor rules l Legislation: States such as California( via AB5) have limited the use of independent contractors in personal services. l Trend: The U. S. Department of Labor is increasing scrutiny of gig-worker classifications, which could affect mobile and freelance spa providers.
